01Who we are

frank merch. is a trading name of Frank Merch Ltd, a company registered in England and Wales. Where these terms say "we", "us" or "our", they mean Frank Merch Ltd. Where they say "you", they mean the person or organisation placing an order or using the site.

02Quotes & orders

A quote is an estimate based on the brief you give us. It is valid for 30 days unless we say otherwise, and it is not a binding offer until we confirm your order in writing.

Your order is accepted only when we send an order confirmation. At that point a contract is formed between you and us on these terms. We may decline an order — for example if artwork infringes someone else’s rights, or a request falls outside what we make.

03Artwork & approval

You are responsible for making sure you have the right to use any logo, image or text you supply. You confirm that your artwork does not infringe anyone’s intellectual property and grant us the licence needed to reproduce it on your order.

We produce to the digital proof you approve. Once you sign off a proof, that is what we make. Please check spelling, colour references and sizing carefully before you approve.

04Pricing & payment

Prices are shown exclusive of VAT unless stated. VAT and delivery are added at checkout or on your final invoice. We may ask for full or partial payment before production begins.

Where we have agreed payment terms, invoices are due within the period stated on the invoice. We may pause production or delivery on overdue accounts.

05Delivery & risk

We deliver across the EU and to the countries listed at checkout. Delivery dates are estimates; while we work hard to hit them, we are not liable for delays outside our reasonable control.

Risk in the goods passes to you on delivery. Title passes once we have received payment in full.

06Custom goods & returns

Because your items are made to your brief, they are personalised goods and are not returnable for a change of mind. This does not affect your rights where goods are faulty or not as described.

If something arrives faulty or differs from the proof you approved, tell us within 14 days of delivery and we will put it right — by remaking, replacing or refunding the affected items.

07Our liability

We do not exclude liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud. Subject to that, our total liability for any order is limited to the amount you paid for it.

We are not liable for indirect or consequential loss, or for loss of profit, revenue or goodwill.

08Governing law

These terms are governed by the law of England and Wales, and disputes are subject to the exclusive jurisdiction of its courts. If any part of these terms is found unenforceable, the rest continues to apply.
